Terms of Service

Please read these terms carefully before using PetrolheadMotor.

1. Acceptance of Terms

By accessing or using PetrolheadMotor ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Platform. We reserve the right to modify these Terms at any time, and your continued use of the Platform following any changes constitutes acceptance of those changes.

2. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you:

  • Are at least 18 years old
  • Have the legal capacity to enter into binding contracts
  • Will provide accurate and complete registration information
  • Will maintain the security of your account credentials
  • Accept responsibility for all activity under your account

3. Auction Rules

All auctions on PetrolheadMotor are subject to the following rules:

3.1 Bidding

  • All bids are binding and cannot be retracted
  • You must bid at least the minimum increment above the current price
  • Auctions may be extended if bids are placed near the closing time
  • Shill bidding and bid manipulation are strictly prohibited

3.2 Reserve and No Reserve Auctions

  • Reserve auctions have a minimum price that must be met for the sale to proceed
  • No Reserve auctions sell to the highest bidder regardless of final price
  • The seller determines the auction type; this cannot be changed after the auction begins

3.3 Winning an Auction

  • The highest bidder at auction close wins the item
  • Winners are obligated to complete the purchase
  • Failure to complete a purchase may result in account suspension and legal action

4. Seller Responsibilities

Sellers on PetrolheadMotor agree to:

  • Provide accurate and complete descriptions of items
  • Disclose all known defects, issues, or problems
  • Provide clear, accurate photographs of items
  • Have clear title and authority to sell listed items
  • Honor the winning bid and complete the sale
  • Respond promptly to buyer inquiries
  • Pay all applicable listing and transaction fees

5. Buyer Responsibilities

Buyers on PetrolheadMotor agree to:

  • Complete thorough due diligence before bidding
  • Bid only amounts they are prepared to pay
  • Complete payment promptly after winning
  • Arrange and pay for shipping or pickup as agreed
  • Communicate promptly with sellers
  • Act in good faith throughout the transaction

6. Fees and Payments

PetrolheadMotor charges fees as follows:

  • Listing fees are charged when an auction goes live
  • Transaction fees may apply to successful sales
  • There is no buyer's premium
  • Payment arrangements are made directly between buyers and sellers
  • All fees are non-refundable unless otherwise specified

7. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PetrolheadMotor:

  • Does not inspect, verify, or guarantee the quality of listed items
  • Is not a party to transactions between buyers and sellers
  • Does not guarantee the identity or authority of users
  • Is not responsible for the accuracy of listings or user-provided information
  • Does not guarantee uninterrupted or error-free service

8. Limitation of Liability

To the maximum extent permitted by law, PetrolheadMotor and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any transaction conducted through the Platform, regardless of the theory of liability.

9. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

10. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Platform ceases immediately, and we may delete your account and associated data.
